The big picture (read this first)

The daf opens still inside yesterday’s argument. A chest-compartment (teivat ha-migdal) stands in a house with a source of impurity sealed in its drawer, and the Gemara is pinning down exactly why the two tannaim rule as they do. The whole first half turns on one fault line R’ Yosei sits astride:

Does hidden impurity break through and rise — tum’a temuna boka’at ve-ola — defiling what is above it even through a covering with no hole? R’ Yosei, we are told, holds it does not. And then the Gemara catches him seeming to hold that it does.

The trap is sprung by the famous mishna of the dog dead on the threshold (Oholot 11:7): a dog ate an olive-bulk of a corpse, died lying half-in and half-out of the doorway, and now the question is whether the house is impure. R’ Yosei rules “from the lintel inward — impure.” Take that at face value and R’ Yosei is saying the impurity buried in the dog’s neck rises through the flesh into the house — hidden impurity breaking through. That is the exact opposite of what we just established.

Rava’s rescue is the hinge of the page: R’ Yosei never meant “look where the impurity lies.” He meant “רוֹאִין אֶת חֲלַל הַטּוּמְאָה” — one looks at the hollow cavity around the impurity. The dog defiles the house only the ordinary way, by a tent drawing impurity along a handbreadth of hollow neck; and R’ Yosei is quarrelling with R’ Meir on two fronts at once — is it the neck’s width or its hollow that matters, and is the whole house impure or only the part under the tent. Hidden impurity still does not break through.

The second half changes gear. R’ Shimon’s baraita of the three impurities — each defiling by exactly two of contact, carrying, and tent — turns out to prove R’ Shimon is the tanna who disagrees with R’ Yosei that a tent counts as “touching.” Then the mishna’s thread on thigh bones resumes: a sealed one is pure because you cannot reach the flesh, and the daf presses that principle until it nearly proves too much (an animal in its hide? a kidney in its fat?), before turning to eggs and to the strange half-earth mouse.

Key concepts & terms

Term Meaning
טוּמְאָה טְמוּנָה בּוֹקַעַת וְעוֹלָה (tum’a temuna boka’at ve-ola) Hidden impurity breaks through and rises — impurity sealed under a covering defiles what is above it even with no hole. The fault line of the whole first half; R’ Yosei holds it does not.
רוֹאִין אֶת חֲלַל הַטּוּמְאָה (ro’in et chalal ha-tum’a) One looks at the hollow cavity of the impurity. Rava’s rereading of R’ Yosei’s word ro’in — not where the impurity lies, but whether the neck holds a hollow handbreadth.
פּוֹתֵחַ טֶפַח (pote’aḥ tefaḥ) An opening of a handbreadth. R’ Meir’s measure: if the dog’s neck is a handbreadth wide it forms a tent and imports impurity. R’ Yosei answers: only if the hollow is a handbreadth.
הַמְשָׁכָה (hamshacha) Drawing — the way a proper tent carries impurity from its source along to the person or house. What actually makes the dog defile, on Rava’s reading — no breaking-through needed.
מַשְׁקוֹף (mashkof / shakof) The lintel of the doorway. R’ Yosei’s line: from the lintel inward the house is impure, from the lintel outward it is pure.
מְלֹא תַרְוָוד רָקָב (melo tarvad rakav) A full ladle of corpse-decay dust. In R’ Shimon’s baraita it defiles by carrying and tent but not contact — you cannot touch every grain at once.
עֶצֶם כִּשְׂעוֹרָה (etzem kis’ora) A bone the size of a barley grain. Defiles by contact and carrying but not in a tent — a law given at Sinai (Tosafot: derived from a verse in Nazir).
גּוֹלֵל וְדוֹפֵק (golel va-dofek) The grave cover and grave wall that support it. Defiles by contact and tent but not by carrying.
מַגָּע / מַשָּׂא / אֹהֶל (maga / masa / ohel) The three routes of corpse-impurity — contact, carrying, and tent. R’ Shimon’s grid asks which one each source lacks.
אֶת שֶׁאֶפְשָׁר לִיגַּע (et she-efshar liga) “That which one can touch.” The rule dividing sealed from perforated — one who can reach the flesh is impure, one who cannot is pure.
מְחוּסַּר נְקִיבָה / מְחוּסַּר מַעֲשֶׂה (meḥusar nekiva / meḥusar ma’aseh) Lacking perforation / lacking an action. Rav Oshaya’s question: is a bone one means to perforate still “sealed,” or does the mere intent already make it defile?
עַכְבָּר שֶׁחֶצְיוֹ בָּשָׂר (achbar she-ḥetzyo basar) The mishna’s half-flesh, half-earth mouse — thought to generate from the ground. Touch the flesh, impure; touch the earth, pure.

רוֹאִין אֶת חֲלַל הַטּוּמְאָה (roín et jalal ha-tumá) Se mira la cavidad hueca de la impureza.
פּוֹתֵחַ טֶפַח (potéaj téfaj) Una abertura de un palmo.
מְלֹא תַרְוָוד רָקָב (meló tarvad rakav) Un cucharón lleno de polvo de descomposición de cadáver.
אֶת שֶׁאֶפְשָׁר לִיגַּע (et sheefshar ligá) “Aquello que se puede tocar.”
מְחוּסַּר נְקִיבָה / מְחוּסַּר מַעֲשֶׂה (mejusar nekivá / mejusar maasé) Falto de perforación / falto de un acto.

Who’s who in today’s daf

Tannaim (the Oholot dispute and R’ Shimon’s baraita)

  • Rabbi Meir — third-generation Tanna, foremost student of R’ Akiva; in the dog mishna he measures by the width of the neck: a handbreadth wide and it imports impurity.
  • Rabbi Yosei (ben Ḥalafta) — third–fourth-generation Tanna of Tzippori, also a student of R’ Akiva; the figure the whole first half revolves around. Holds hidden impurity does not break through, and — on Rava’s reading — looks to the neck’s hollow, not its width.
  • Rabbi Elazar — the Tanna named in the dog mishna (mouth inward, house pure; mouth outward, house impure, since impurity exits through the rear). Most likely R’ Elazar ben Shammua; I would not press the identification harder than that.
  • Rabbi Yehuda ben Beteira — Tanna of Netzivin (Nisibis) in Babylonia; rules the house impure either way, since the impurity can leave through mouth or rear.
  • Rabbi Shimon (bar Yoḥai) — third-generation Tanna, student of R’ Akiva; his baraita of the three impurities is the tanna who disagrees with R’ Yosei — for R’ Shimon a tent is not “touching,” which is why dust can defile in a tent yet not by contact.
  • Rabbi Yehuda (bar Ilai) — third-generation Tanna, student of R’ Akiva; in the mouse mishna he extends impurity to the earth adjacent to the flesh.

Amoraim

  • Rava (bar Yosef bar Ḥama) — fourth-generation head of Maḥoza; author of the rescue — R’ Yosei “looks at the hollow cavity” and argues on two fronts. (Rava, רבא — not Rabbah, רבה; no Rabbah appears here.)
  • Rav Aḥa, son of Rava — fifth-generation Babylonian Amora; teaches Rava’s reading as explicit in the mishna. (Distinguish Rav Aḥa son of Rava from Rav Aḥa bar Rav Ashi — a different sage.)
  • Abaye — fourth-generation head of Pumbedita; fields R’ Zeira’s challenge with the animal’s orifices.
  • Rabbi Zeira — third-generation Amora who went up from Bavel to Tiberias; presses that an animal in its hide should not defile if a sealed bone does not.
  • Rav Pappa — fifth-generation Babylonian Amora, student of Abaye and Rava; presses the parallel case of a kidney sheathed in its fat.
  • Rav Oshaya — the Amora who raises and then resolves the “intended to perforate” dilemma. A minor voice here (the text shifts between Rav and Rabbi Oshaya); I would not build a biography on him.
  • Rabbi Yehoshua ben Levi — first-generation Amora of Lod (Lydda), Eretz Yisrael; qualifies the mouse — impure by its flesh only if flesh has formed along the creature’s entire length. (Not R’ Yehoshua the Tanna.)

(Rava, רבא — no Rabá, רבה; aquí no aparece ningún Rabá.)

And it is taught with regard to that halakha in the mishna that Rabbi Yosei deems it pure. To which halakha in the mishna is this referring? If we say that it is referring to the latter clause of the mishna, which discusses a chest placed in the entrance of the house, the first tanna also deems it pure in that case.
Rather, it is clear that the first tanna says that if a source of impurity is inside the compartment of a chest that is inside the house, the house is impure, either because it is typical for a source of impurity to exit its location, or because he holds that a hidden source of impurity breaks through and ascends. And Rabbi Yosei disagrees and says to him: With regard to that which you say that it is typical for a source of impurity to exit its location, it is not necessarily so. One can remove the impure item in halves or burn it in its place inside the compartment. And with regard to that which you say that a hidden source of impurity breaks through and ascends, a hidden source of impurity does not break through. Consequently, Rabbi Yosei must hold that a hidden source of impurity does not break through and ascend.
new sugyaBased on the previous statement of Rabbi Yosei, the Gemara established that Rabbi Yosei holds that a hidden source of impurity does not break through and ascend. And the Gemara raises a contradiction between that previous statement of Rabbi Yosei and another statement of Rabbi Yosei.
As we learned in a mishna (Oholot 11:7): In the case of a dog that ate the flesh of a corpse, and the dog then died and is lying on the threshold in such a manner that its neck and mouth are facing toward the inside of the house, Rabbi Meir says: If there is an opening the size of one cubic handbreadth inside the neck of the dog, i.e., the neck itself constitutes this measure, the dog imports impurity into the house because the upper portion of the dog’s body overlies the impure item inside the dog and the impurity is transmitted through the neck and mouth of the dog into the house. But if there is not such a large cavity in the neck of the dog, then there is no halakha of a tent, and the dog does not import the impurity into the house.
Rabbi Yosei says: One looks to determine exactly where on the threshold the dog is located. If the impure item inside the dog is located anywhere from opposite, i.e., under, the lintel and toward the inside of the house, the house is impure. If the dog is located anywhere from opposite the lintel and toward the outside of the house, the house remains pure.
Rabbi Elazar says: One must determine the exact manner in which the dog is lying on the threshold. If its mouth is located inside the house, but its rear is located outside the house, the house remains pure. If its mouth is located outside the house but its rear is located inside the house, the house is impure. This is because the source of impurity exits the dog’s body through its edge, i.e., its rear.
Rabbi Yehuda ben Beteira says: In both this case and that case, i.e., whether the dog is lying such that its mouth is inside the house or outside the house, the house is impure. The reason is that the impure item can exit through either the mouth or the rear.
The Gemara analyzes the statement of Rabbi Yosei that if the dog is located anywhere from under the lintel and toward the inside of the house, the house is impure. What, is the statement of Rabbi Yosei not referring to a case where there is not an opening the size of one cubic handbreadth inside the dog’s neck, with regard to which Rabbi Meir says that the house remains pure? Accordingly, Rabbi Yosei is responding to Rabbi Meir and saying: Even if the neck of the dog is not the size of one cubic handbreadth, as long as the impure item inside the dog is located from under the lintel and toward the house, the house is impure because it overlies the impure item.
And therefore learn from it that Rabbi Yosei holds that a hidden source of impurity breaks through and ascends, contrary to Rabbi Yosei’s opinion as understood from his previous statement.
Rava said: Rabbi Yosei holds that a hidden source of impurity does not break through and ascend. As for that which Rabbi Yosei teaches: One looks whether the impure item inside the dog is located opposite the lintel and toward the inside of the house, Rabbi Yosei actually teaches: One looks at the empty space adjacent to the source of impurity. And Rabbi Yosei disagrees with Rabbi Meir with regard to two matters, and says to Rabbi Meir: As for that which you say that if there is the width of one cubic handbreadth in the neck of the dog, it imports the impurity into the house, that is not so. Rather, we follow the measure of the empty space, i.e., the neck of the dog imports impurity into the house only if it contains a cubic handbreadth of space in addition to the thickness of the flesh of the neck itself.
And with regard to that which you say that even if the dog is located on the outer portion of the threshold of the house, the entire house is impure, that is not so. Rather, if the impurity inside the dog is located anywhere from opposite the lintel and toward the inside of the house, the house is impure. If the impurity inside the dog is located anywhere from opposite the lintel and toward the outside of the house, the house remains pure.
Rav Aḥa, son of Rava, teaches that Rava’s explanation is explicit in the mishna itself, as follows: Rabbi Yosei says: One looks at the empty space adjacent to the source of impurity.
new sugyaPreviously the Gemara established that Rabbi Yosei holds that with regard to the halakhot of impurity, overlying is referred to as touching, as the transmission of impurity via contact and via overlying are considered one category. But the mishna (Oholot 3:1) cited earlier (125b) states that in the case of one who touches half an olive-bulk of flesh of a corpse, if a tent simultaneously overlies him and another half an olive-bulk of flesh he remains pure. Evidently, there is a tanna who disagrees with Rabbi Yosei and holds that these two methods of transmitting impurity are not the same category. The Gemara asks: Who is the tanna who disagrees with Rabbi Yosei? The Gemara answers: It is Rabbi Shimon, as it is taught in a baraita: Rabbi Shimon says:

Parts of a corpse that impart impurity include an olive-bulk of flesh, a complete limb, the majority of a corpse’s bones, and the majority of the essential bones of its skeleton, namely, its legs, spine, and ribs. All of these impart impurity via contact, carrying, and in a tent. There are also three sources of impurity that derive from a corpse, each one of which imparts impurity in two ways but does not impart impurity in a third way. And they are the following: A full ladle of dust from a corpse, and a bone the size of a barley grain, and a grave cover [golel] and a grave wall [dofek] upon which the cover rests.
A full ladle of dust imparts impurity via carrying and in a tent, but it does not impart impurity via contact, as it is impossible for one to touch all of the particles of dust simultaneously. And where among these sources of impurity is the imparting of impurity via contact applicable? It is applicable with one of those other two sources of impurity, i.e., a bone the size of a barley grain and the cover or wall of a grave.
A bone the size of a barley grain imparts impurity via carrying and contact, but it does not impart impurity in a tent. This halakha was transmitted to Moses from Sinai. And where among these sources of impurity is impurity imparted in a tent? It is with one of those other two sources of impurity.
A grave cover and a grave wall impart impurity via contact and in a tent, but they do not impart impurity via carrying. This halakha too was transmitted to Moses from Sinai. And where among these sources of impurity is impurity transmitted via carrying? It is with one of those other two sources of impurity. It may be inferred from Rabbi Shimon’s statement that a full ladle of dust imparts impurity in a tent but not via contact that he disagrees with Rabbi Yosei and holds that overlying is not the same category as touching.
new sugyaThe mishna teaches: With regard to the thigh bone of an unslaughtered carcass and the thigh bone of a creeping animal, one who touches them when they are sealed remains ritually pure, because the bone itself does not impart impurity. With regard to this topic, the Sages taught in a baraita: The verse states: “One who touches the carcass thereof shall be impure until the evening” (Leviticus 11:39). The word “carcass” indicates that one who touches the carcass is impure, but one who touches a sealed thigh bone is not.
One might have thought that even one who touches a perforated thigh bone remains pure. Therefore, the verse states: “One who touches the carcass thereof [benivlatah] shall be impure,” indicating that one who touches a part of the animal through which it is possible to touch the flesh, which has the halakhic status of an unslaughtered carcass [neveila], is impure, but one who touches a part of the animal through which it is impossible to touch the flesh remains pure. Therefore, one who touches a protective layer such as the outside of a sealed thigh bone does not become impure, as it is impossible to touch the marrow.
Rabbi Zeira said to Abaye: If that is so, that one who touches the protective layer of a carcass via which it is impossible to touch the flesh of the carcass itself does not become impure, an animal still in its hide should not impart impurity, as one can touch the hide, which constitutes a protective layer, but not the flesh. Abaye answered: Go out and see how many orifices there are in the body of an animal via which one can touch the flesh, e.g., the eyes, the nostrils, and the mouth.
Similarly, Rav Pappa said to Rava: If that is so, that one who touches the protective layer of a carcass via which it is impossible to touch the flesh of the carcass itself does not become impure, the kidney of a carcass that is completely covered in its fat should not impart impurity via contact. Rava answered: Come and see how many sinews emerge from the kidney that one is able to touch.
new sugyaThe mishna taught that the halakha distinguishes between a sealed and a perforated thigh bone of a carcass or a creeping animal. With regard to this topic, Rav Oshaya raises a dilemma: What is the halakha if one intended to perforate the thigh bone but did not yet perforate it? This is the dilemma: Is a thigh bone lacking perforation considered to be lacking the necessary action for it to impart impurity, and it therefore retains its status as a sealed thigh bone, or not?
Rabbi Oshaya then resolves the dilemma: A thigh bone lacking perforation is not considered to be lacking the necessary action for it to impart impurity. If one intends to perforate it, it imparts impurity immediately.
MISHNA: The egg of a creeping animal in which tissue of an embryo developed and one who comes into contact with the egg are ritually pure, as the impure creeping animal is hermetically sealed. But if one perforated the egg with a hole of any size, one who comes in contact with the egg is ritually impure. In the case of a mouse that grows from the ground and is half-flesh half-earth, one who touches the half that is flesh is impure; one who touches the half that is earth is pure. Rabbi Yehuda says: Even one who touches the half that is earth where it is adjacent to the flesh is ritually impure.
GEMARA: The mishna states that in the case of an egg of a creeping animal in which tissue of an embryo developed, if it is perforated then one who touches it is ritually impure. With regard to this matter the Sages taught in a baraita: The verse states: “These are the impure ones to you among all that creep; whoever touches them when they are dead shall be impure until the evening” (Leviticus 11:31). The term “the impure ones” is interpreted as including the egg of a creeping animal and the thigh bone of a creeping animal in the category of sources of impurity.
One might have thought that even an egg in which tissue of an embryo has not developed imparts impurity. Therefore, the verse states: “That creep,” indicating that just as a creeping animal has developed tissue, so too only the egg of a creeping animal in which tissue of an embryo has developed imparts impurity.
One might have thought that in the case of an egg in which tissue of an embryo has developed, it imparts impurity even if it was not perforated. Therefore, the verse states: “Whoever touches them when they are dead shall be impure,” indicating that when it is possible to touch the flesh, contact renders one impure; but when it is impossible to touch the flesh, one remains pure.
And how large must its perforation be to render one touching the egg or thigh bone impure? Its width must be the size of a strand of hair, as it is possible for one to touch the inside of an egg or thigh bone with a strand of his hair.
new sugyaThe mishna teaches: In the case of a mouse that grows from the ground and is half-flesh half-earth, one who touches the half that is flesh is impure. Rabbi Yehoshua ben Levi says in this regard: One becomes impure in such a case only if the flesh of the mouse has developed along the entire length of the mouse, from head to foot. Some teach the statement of Rabbi Yehoshua ben Levi with regard to the latter clause of the mishna: Rabbi Yehuda says: Even one who touches the half that is earth where it is adjacent to the flesh is ritually impure. Rabbi Yehoshua ben Levi says: One becomes impure in such a case only if the flesh of the mouse has developed along the entire length of the mouse.
The one who teaches the statement of Rabbi Yehoshua ben Levi with regard to the first clause of the mishna, all the more so he teaches this same halakha with regard to the latter clause of the mishna. But the one who teaches the statement of Rabbi Yehoshua ben Levi with regard to the latter clause of the mishna holds that it applies only to that clause, with regard to one who touches the half that is earth where it is adjacent to the flesh according to Rabbi Yehuda. But according to the opinion of the first tanna, stated in the first clause of the mishna, even if the flesh of the mouse has not developed along the entire length of the mouse, one who touches the half of the mouse that is flesh is impure.
new sugyaThe Sages taught in a baraita concerning the following verse: “And these are they which are impure to you among the creeping animals that creep upon the earth: The weasel, and the mouse, and the great lizard after its kinds” (Leviticus 11:29). Since “mouse” is stated among the creeping animals that impart impurity, I would derive that even a sea mouse, i.e., a sea creature that has an appearance similar to a mouse, imparts impurity because its name is also mouse. But ostensibly, the opposite conclusion could be derived through logical inference: The verse deems a weasel impure and deems a mouse impure. Therefore, just as a weasel is a species that grows on land, so too the mouse to which the verse is referring is a species that grows on land; a sea mouse does not impart impurity.
Or, perhaps go this way: The verse deems a weasel impure and deems a mouse impure; accordingly, just as “weasel” is referring to any animal whose name is weasel, so too, “mouse” is referring to any animal whose name is mouse, even a sea mouse, as its name is also mouse. Therefore, the verse states: “Upon the earth,” indicating that a land mouse imparts impurity, but a sea mouse does not.
If this halakha is derived only from the phrase “upon the earth,” one might have thought that the verse means that any mouse, whether a land mouse or a sea mouse, imparts impurity when it is upon the earth, but if it descended to the sea it does not impart impurity.

Walking through the sugya, step by step

126a — On which clause did R’ Yosei rule pure?

Where we are. The chest-compartment argument from 125b runs on. The Gemara asks “אַהֵיָיא?” — to which clause does R’ Yosei’s ruling of pure attach? Not the latter clause (a chest in the entrance), since the first tanna deems that pure too. Rather, the first tanna held: impurity inside the compartment makes the house impure — “אִי מִשּׁוּם דְּדֶרֶךְ טוּמְאָה לָצֵאת, וְאִי מִשּׁוּם דְּטוּמְאָה טְמוּנָה בּוֹקַעַת” — either because impurity tends to exit, or because hidden impurity breaks through.

R’ Yosei’s two answers. To “impurity tends to exit,” R’ Yosei replies: “יָכוֹל הוּא לְהוֹצִיאָהּ לַחֲצָאִין אוֹ לְשׂוֹרְפָהּ בִּמְקוֹמָהּ” — one could remove it piecemeal or burn it in place, so it need not exit. And to “hidden impurity breaks through,” he replies flatly: “טוּמְאָה טְמוּנָה אֵינָהּ בּוֹקַעַת” — hidden impurity does not break through. Hold onto that line.

126a — The contradiction: R’ Yosei against R’ Yosei

The clash. “וְרָמֵי דְּרַבִּי יוֹסֵי אַדְּרַבִּי יוֹסֵי” — the Gemara sets R’ Yosei against himself, from the mishna of the dog. A dog ate corpse-flesh, died on the threshold with its neck facing in, and:

  • R’ Meir: “אִם יֵשׁ בְּצַוָּארוֹ פּוֹתֵחַ טֶפַח – מֵבִיא אֶת הַטּוּמְאָה” — if the neck is a handbreadth wide it imports impurity; if not, it does not.
  • R’ Yosei: “רוֹאִין מִכְּנֶגֶד הַשָּׁקוֹף וְלִפְנִים – הַבַּיִת טָמֵא” — one looks; from the lintel inward the house is impure, from the lintel outward pure.
  • R’ Elazar: mouth inward — pure; mouth outward — impure, “מִפְּנֵי שֶׁטּוּמְאָה יוֹצְאָה דֶּרֶךְ שׁוּלָיו”, because impurity exits through the rear.
  • R’ Yehuda ben Beteira: either way, impure.

The problem. — surely R’ Yosei is speaking where the neck is not a handbreadth, and still rules impure from the lintel inward. But then the impurity in the dog’s neck is hidden, with no tent to draw it — so “וּשְׁמַע מִינַּהּ: טוּמְאָה טְמוּנָה בּוֹקַעַת!” — learn from it that hidden impurity breaks through, exactly against what we just fixed.

126a — Rava: “one looks at the hollow”

The rescue. “אָמַר רָבָא: רוֹאִין אֶת חֲלַל הַטּוּמְאָה קָתָנֵי” — R’ Yosei’s word ro’in does not mean “look where the impurity lies.” It means look at the hollow cavity of the neck — is there a handbreadth of empty space, enough to form a tent that draws the impurity? And “רַבִּי יוֹסֵי בְּתַרְתֵּי פְּלִיג” — R’ Yosei is disagreeing with R’ Meir on two points at once:

  1. Width versus hollow. To R’ Meir’s “a handbreadth wide imports impurity,” R’ Yosei answers “אֲנַן בָּתַר חֲלָלַהּ אָזְלִינַן” — we follow the hollow, not the outer width; the neck’s flesh does not count, only a handbreadth of open cavity.
  2. Whole house versus part. To “the whole house is impure,” R’ Yosei answers: from the lintel inward impure, from the lintel outward pure — only the stretch the tent actually overlies.

So R’ Yosei defiles the house the ordinary way — a tent drawing impurity through a hollow neck — and hidden impurity still does not break through. No contradiction.

Made explicit. “רַב אַחָא בְּרֵיהּ דְּרָבָא מַתְנֵי לַהּ בְּהֶדְיָא” — Rav Aḥa son of Rava simply teaches the mishna that way: R’ Yosei says outright, “one looks at the hollow cavity of the impurity.”

126a — Who disagrees with R’ Yosei? R’ Shimon

The question. R’ Yosei calls a tent a kind of “touching.” — and who is the tanna who holds a tent is not touching, so that the half-olive one touches and the half a tent overlies do not combine (the Oholot 3:1 mishna cited on 125b)? “רַבִּי שִׁמְעוֹן הוּא” — it is R’ Shimon.

126b — R’ Shimon’s three impurities

The baraita. “שָׁלֹשׁ טוּמְאוֹת פּוֹרְשׁוֹת מִן הַמֵּת, שְׁתַּיִם בְּכׇל אַחַת וּשְׁלִישִׁית אֵין בָּהֶן” — three impurities separate from the corpse, each with two of the three routes and not the third:

  • A ladle of corpse-dust (melo tarvad rakav): carrying and tent — not contact, since you cannot touch every grain at once. This is the proof: dust defiles in a tent but not by touch, so for R’ Shimon a tent is not touching — against R’ Yosei.
  • A barley-grain bone (etzem kis’ora): contact and carrying — not tent (a law from Sinai).
  • A grave cover and wall (golel va-dofek): contact and tent — not carrying.

And the missing route of each is supplied “עִם אַחַת מֵהֶן” — by joining one of the other two.

126b — Sealed thigh bones: “that which one can touch”

The baraita. The mishna’s thigh-bone thread resumes. “בְּנִבְלָתָהּ – וְלֹא בְּקוּלִית סְתוּמָה” — “its carcass” defiles, but not a sealed thigh bone. Might even a perforated one stay pure? יִטְמָא” — the verse teaches: “אֶת שֶׁאֶפְשָׁר לִיגַּע – טָמֵא, וְאֶת שֶׁאִי אֶפְשָׁר לִיגַּע – טָהוֹר” — what one can touch is impure, what one cannot is pure. Sealed, you cannot reach the marrow; perforated, you can.

Pressing the principle too far. If “cannot touch” means pure, two objections land:

  • R’ Zeira to Abaye: “בְּהֵמָה בְּעוֹרָהּ לֹא תְּטַמֵּא?” — then an animal still in its hide should not defile, for you touch only the hide! Abaye: “פּוֹק חֲזִי כַּמָּה נְקָבִים יֵשׁ בָּהּ” — go see how many orifices it has — eyes, nostrils, mouth — through which you can reach the flesh.
  • Rav Pappa to Rava: “כּוּלְיָא בְּחֶלְבָּהּ לֹא תְּטַמֵּא?” — then a kidney sheathed in its fat should not defile! Rava: “תָּא חֲזִי כַּמָּה חוּטִין נִמְשָׁכִין הֵימֶנָּה” — come see how many sinews run out of it that you can touch.

Rav Oshaya’s dilemma. — he meant to perforate the bone but has not yet. Is “מְחוּסַּר נְקִיבָה כִּמְחוּסַּר מַעֲשֶׂה” — is a bone lacking perforation like one lacking a real action, still sealed? He resolves it himself: “לָאו כִּמְחוּסַּר מַעֲשֶׂה דָּמֵי” — not like lacking an action; the intent is enough, and it defiles as if already open.

126b — The mishna: eggs, and the half-earth mouse

The mishna. “בֵּיצַת הַשֶּׁרֶץ הַמְרוּקֶּמֶת טְהוֹרָה” — a creeping-thing’s egg in which an embryo has formed is pure (sealed); “נִיקְּבָה כׇּל שֶׁהוּא – טָמֵא”, perforated the least bit, impure. And the “עַכְבָּר שֶׁחֶצְיוֹ בָּשָׂר וְחֶצְיוֹ אֲדָמָה” — a mouse half flesh, half earth (thought to grow from the ground): touch the flesh, impure; the earth, pure. R’ Yehuda: even the earth adjacent to the flesh is impure.

The derivations. “הַטְּמֵאִים” includes the egg and the thigh bone of a creeping thing. Might even an undeveloped egg defile? “הַשֶּׁרֶץ” — just as a creeping thing has formed, so only a developed egg. Might even an unperforated one? And how large a hole? “כְּחוּט הַשַּׂעֲרָה” — the width of a hair, since with a hair’s strand you can reach inside.

The mouse. “אָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: וְהוּא שֶׁהִשְׁרִיץ עַל פְּנֵי כּוּלּוֹ” — R’ Yehoshua ben Levi qualifies it: impure by its flesh only where flesh has formed along the creature’s whole length. The daf then opens a baraita on whether a sea-mouse defiles — the thread that carries into 127a.

The distinctions, side by side

R’ Shimon’s baraita is a perfect grid: three impurities from the corpse, each defiling by exactly two of the three routes. The missing route of each is supplied only by joining one of the others. Every cell traces to the walkthrough above.

One line to carry with you

A word can carry a hidden second meaning, and a page can turn on catching it: R’ Yosei’s “one looks” was never about where the impurity lies but about whether there is a hollow to look into — and the whole contradiction dissolves the moment you read the cavity instead of the corpse.

Y a “la impureza oculta atraviesa,” responde rotundo: “טוּמְאָה טְמוּנָה אֵינָהּ בּוֹקַעַת” — la impureza oculta no atraviesa.

  • R’ Zeirá a Abaie: “בְּהֵמָה בְּעוֹרָהּ לֹא תְּטַמֵּא?”
  • Rav Papa a Rava: “כּוּלְיָא בְּחֶלְבָּהּ לֹא תְּטַמֵּא?”
